02

Applicability

These General Terms and Conditions apply to all quotations, agreements, services and communication between A&M and the client. Deviations are only valid if agreed in writing. By using the services of A&M, the client declares that they accept these terms and conditions.

03

Nature and scope of the services

A&M provides administrative support and guidance with Spanish procedures. The services include, among other things:

  • completing official documents such as EX-15, EX-18, Seguridad Social forms and other forms;
  • checking documents for completeness (not for legal validity);
  • preparing files;
  • scheduling appointments with official authorities;
  • accompanying clients during appointments;
  • paying fees (tasas) where this is part of the service;
  • providing explanations and advice on administrative procedures.

A&M does not act as a legal adviser, gestoría, lawyer or representative. A&M cannot give any guarantees about the outcome of procedures and is not responsible for decisions made by official authorities.

No responsibility for foreign administration

A&M is not responsible for administrative procedures, documents, legalisations, apostilles, applications or obligations relating to the client's home country. The client remains fully responsible for obtaining, legalising and providing all foreign documents required for Spanish procedures.

The client remains fully responsible for:

  • the accuracy of all information provided;
  • the content of documents;
  • providing the required documents on time;
  • official applications and contracts.
04

Obligations of the client

The client must provide all required information completely, correctly and on time. Changes to personal details (address, passport, NIE, marital status, etc.) must be reported immediately. If information turns out to be incorrect or incomplete, A&M is entitled to suspend or terminate the services.

05

Liability

A&M is not liable for:

  • errors, delays or rejections caused by official authorities;
  • system failures at town halls, police, Seguridad Social or other government services;
  • errors made by third parties;
  • damage resulting from incorrect or incomplete information provided by the client;
  • indirect damage such as fines, missed appointments, delays or consequential damage;
  • administrative obligations or errors in the client's home country.

If A&M is held liable, this liability is limited to the invoice amount of the service concerned. A&M is never liable for consequential damage.

06

Fees, payment and cancellation

  • An advance payment of 50% of the total amount is required before the services start.
  • The remaining 50% must be paid in full before the last appointment that A&M has scheduled for the client.
  • If payment is not made, A&M is entitled to suspend the services.
  • If the client cancels, work already carried out will always be charged.
  • The advance payment is non-refundable as soon as A&M has carried out any work in connection with the assignment. Work includes, among other things: advice, building the file, checking documents, correspondence, preparing forms, scheduling appointments and other administrative or preparatory actions.
  • The client is informed in writing in advance about the content of the services and the associated fees. By agreeing to a quotation, price estimate, email or other written confirmation of the services, the client confirms that they are aware of and accept these costs.
  • Cancellation, termination of the assignment or a change in the client's wishes does not entitle the client to a refund of amounts already paid for work carried out.
07

Use of third parties

A&M may engage third parties for specific parts of the services. A&M is not liable for the actions, advice, errors or delays of these third parties. The client agrees to the sharing of necessary data with third parties where this is required to perform the service.

08

Confidentiality and data protection

A&M processes personal data solely for the performance of the agreement and in accordance with applicable privacy legislation (GDPR). Data is not shared with third parties unless this is necessary for the services or required by law.

09

Complaints procedure

Complaints must be submitted in writing by email or message. A&M will confirm receipt and respond within 14 days. Submitting a complaint does not suspend the obligation to pay.

10

Force majeure

A&M is not liable for delays or shortcomings resulting from force majeure, including technical failures, illness, strikes, government measures or other circumstances beyond A&M's control.

11

Governing law, language & competent court

All agreements and services are governed by Spanish law. Both parties expressly accept this. Disputes will be submitted to the competent court in the province of Alicante. If these terms and conditions are available in several languages, the Spanish version prevails.
